Virginia Voters Approve Constitutional Amendment Protecting Abortion Access
Virginia voters approved a constitutional amendment on November 3 that establishes a fundamental right to reproductive freedom within the state. The measure, which passed with approximately 61% of the vote, enshrines abortion access in the state constitution and creates significant legal barriers for future lawmakers seeking to restrict the practice.
The amendment protects abortion access throughout the first two trimesters. During the third trimester, the measure permits restrictions unless a physician determines an abortion is necessary to protect the mother’s life, physical health, or mental health, or if the fetus is deemed non-viable.
Pro-life organizations have expressed concern that the broad health exceptions could effectively allow for abortions up until birth, arguing the amendment removes essential protections for the unborn. Conversely, supporters of the measure maintain that the amendment is necessary to safeguard medical autonomy and ensure access to care during complicated pregnancies. This development follows the 2022 Supreme Court decision to overturn Roe v. Wade, which shifted the authority to regulate abortion policy to individual states.
