UK Supreme Court to Hear Challenge Against VAT on Private School Fees

The UK Supreme Court is scheduled to hear an appeal on December 1 and 2, 2026, regarding the imposition of Value Added Tax (VAT) on independent school fees. The legal challenge, supported by the Christian Legal Centre, involves several institutions including Emmanuel School, The Branch Christian School, The King’s School Southampton, and Wyclif Independent Christian School. Claimants are asking the court to determine if the government’s policy maintains a fair balance between its fiscal objectives and the significant financial burden placed on families seeking faith-based education.

Critics of the policy argue that the tax, combined with increased regulation of home education and changes to Religious Education curricula, creates a restrictive environment for Christian families. They contend that these measures effectively limit access to Christ-centered schooling by making alternatives unaffordable and increasing state oversight of home-educated children. While the government maintains that these schools remain free to operate, proponents of the legal challenge argue that the cumulative effect of these policies pressures parents to move away from traditional Christian educational settings.
