A 2023 Pentagon memo, recently made public, warned that Biden administration policies concerning gender identity, pronoun usage, and facility access created significant religious liberty concerns for U.S. military personnel. The document noted that service members holding traditional beliefs regarding biological sex faced potential conflicts between their religious convictions and Defense Department mandates. Advocates argued that compelling personnel to use preferred pronouns could violate First Amendment protections and the Religious Freedom Restoration Act.
While existing military policy allows for the accommodation of sincerely held religious beliefs, these protections are subject to considerations of unit cohesion and military readiness. The release of this memo coincides with recent shifts under the Trump administration, as Defense Secretary Pete Hegseth announced the establishment of a new Office of Religious Affairs.
