Christian therapists challenge Lincoln, Nebraska, ordinance on counseling

Two Christian therapists have filed a lawsuit against the city of Lincoln, Nebraska, challenging a municipal ordinance that prohibits counseling minors regarding sexual orientation or gender identity. The plaintiffs, Thomas Dierks and an anonymous counselor, argue that the regulations, which carry penalties including potential jail time, fines, and the loss of professional licenses, violate their First Amendment rights to free speech. The complaint further asserts that the ordinance is unconstitutionally vague under the 14th Amendment.

The lawsuit contends that the city is improperly interfering in private counseling sessions and censoring discussions initiated by young clients. Represented by the Thomas More Society, the therapists argue that the government should not restrict the guidance provided by trusted professionals. A spokesperson for the city of Lincoln confirmed that the ordinance was enacted in February 2021 and stated that the City Attorney’s Office has not yet submitted a formal response to the legal challenge.
