Brazilian Prosecutors Seek to Reopen Transphobia Case Against Student

Federal prosecutors in Brazil have filed an appeal to reopen a criminal case against veterinary student Isadora Borges, who faces a potential 10-year prison sentence over social media posts. The legal action follows a March ruling by the Federal Regional Court of the Fifth Region, which unanimously dismissed all charges against Borges. In that decision, three judges concluded that her posts did not incite violence or demonstrate the criminal intent required for a conviction under Brazilian law.

ADF International, which is providing legal support for Borges, has criticized the appeal as an attempt to suppress freedom of speech. Legal counsel Julio Pohl argued that the initial dismissal established a vital precedent protecting personal opinion from criminal prosecution. Borges, who maintains that her comments regarding biological sex were not intended to target individuals, expressed concern over the potential for renewed legal proceedings. The case is now being directed to the Superior Tribunal of Justice, where prosecutors hope to overturn the previous acquittal.
